Terms of Service

These terms govern your use of Social Magic. By connecting a social account and using the service, you agree to them. They take effect on the “Last updated” date shown above and replace any earlier version.

The service

Social Magic lets you create, schedule, and publish content to social media accounts you connect, and view analytics for the content we publish for you.

Your responsibilities

  • You may only connect accounts you own or are authorized to manage.
  • You are responsible for the content you publish and for complying with each platform’s rules (Meta, TikTok, YouTube, LinkedIn, X, Google Business Profile), including their content, branded-content, and music-usage policies.
  • You must not use the service to post unlawful, infringing, or abusive content.

Platform terms

Your connected accounts remain governed by each platform’s own terms. We act only on the permissions you grant and only to provide the features described. You can revoke access at any time by disconnecting an account or removing the app from the platform.

Availability and changes

We may update or modify the service and these terms. Every change is reflected by the “Last updated” date above. Where a change materially reduces your rights or materially changes what you pay, we will also tell you by email to the address on your account, or by a notice in the app, before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.

Disclaimer of warranties

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, publishing depends on third-party platform APIs that we do not control and that may change, impose limits, or become unavailable. We do not warrant that a post will publish at a particular time, that analytics will be complete or available for every platform, or that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for any lost profits, lost revenue, lost data, or loss of goodwill, arising out of or relating to your use of the service — even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the service is limited to the greater of (a) the fees you paid us in the twelve months before the event giving rise to the claim, or (b) CAD $100.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including under the Consumer Protection Act, 2002 (Ontario) where it applies to you.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to conflict-of-laws rules. You and Social Magic submit to the exclusive jurisdiction of the courts located in Ontario, Canada.
